State context

Maine's 16 sheriffs are constitutional county officers, elected to four-year terms under Me. Const. Art. IX and the qualification requirements of 30-A M.R.S. § 371-B, which requires Maine Criminal Justice Academy certification, a Law Enforcement Code of Ethics oath, no Class C-or-higher conviction, and a Secretary of State background check. Under 30-A M.R.S. § 401, the sheriff is the chief county law enforcement officer who administers the sheriff's department as authorized by the county budget; county commissioners review budget compliance but issue no direct orders to deputies.

The Maine Criminal Justice Academy Board of Trustees is the statewide officer-certification body and, as of 2024, may decertify an officer for non-criminal unprofessional conduct, but no Maine county has created a civilian board with jurisdiction over its sheriff's office. Maine has no consolidated city-county government and no independent city; all 16 sheriffs are elected, county-administered officers, with no appointed or civil-process-only seat, no state-employee sheriff, and no separate county police department operating alongside a sheriff's office. Some sheriff's offices run an internal Civil Process or Police Services division alongside patrol and corrections, but these are divisions within the sheriff's office rather than freestanding agencies.
