Virginia has one of the country's strongest civilian-oversight enabling statutes — Va. Code § 9.1-601 (HB 5055, 2020 Special Session I) — that authorizes county Law Enforcement Civilian Oversight Bodies with subpoena power, binding discipline authority, and investigative independence. But the statute explicitly excludes sheriffs and deputy sheriffs from its definition of "law-enforcement officer," so no Virginia LECOB covers a sheriff's office.

State context

HB 2291 (2021) attempted to amend § 9.1-601 to add sheriff scope; the House passed it 53–46 but it was held in Senate Judiciary and never enacted. No subsequent bill has succeeded.

The practical effect: Arlington's Community Oversight Board (2023, with subpoena power) covers Arlington County PD only, not the elected Sheriff. Fairfax County's Police Civilian Review Panel + Independent Police Auditor cover Fairfax County PD only. Loudoun, Prince William, Albemarle, and Henrico have either advisory committees or no bodies at all. In most Virginia counties the sheriff runs the jail, provides court security, and (in rural counties) is the primary LE agency — entirely outside the LECOB framework.
