State context

Idaho's 44 sheriffs are constitutional officers under Idaho Const. Art. XVIII, § 6, which requires the legislature to provide for a sheriff's popular election every four years in each county; the office's statutory duties are set out in Idaho Code Title 31, Chapter 22, and Idaho Code § 31-2001 lists the sheriff among the county's elected officers. Idaho has no enabling legislation for civilian oversight of a sheriff's office, and no county has established one; the City of Boise's Office of Police Accountability reviews the Boise Police Department, a municipal agency, not any county sheriff.

No Idaho state agency inspects or sets standards for county jails; jail inspections are instead conducted on a voluntary basis by the Idaho Sheriffs' Association, a private association, and its inspection reports are not public (Prison Legal News, 2025). No Idaho county operates a consolidated city-county government, an independent city outside a county, or a separate county police department alongside its elected sheriff, though an incorporated city may contract out of sheriff patrol coverage, as the City of Ketchum did when it ended a 17-year law-enforcement agreement with the Blaine County Sheriff's Office to form its own municipal police department. As of July 2026, Shoshone County's sheriff seat is vacant, and Butte, Camas, Custer, and Jerome counties are led by an appointed sheriff with no subsequent election yet listed.
